Politically Exposed Persons (PEP) Search

The list of Politically Exposed Persons (“PEP”) is useful for Subscribers for the conducting Customer Due Diligence (“CDD”) analysis.

The common definition of PEP is:

  1. an individual who is or has been entrusted with a prominent public function in a recongised jurisdiction and
    1. includes a head of state, head of government, senior politician, senior government, judicial or military official, senior executive of a state-owned corporation and an important political party official; but
    2. does not include a middle-ranking or more junior official of any of the categories mentioned in subparagraph (1);
  2. a spouse, a partner, a child or a parent of an individual falling within paragraph (a), or a spouse or a partner of a child of such an individual; or
  3. a close associate of an individual falling within paragraph (a);

ECM has provided a List of PEP readily available for Subscribers to conduct Online search or ECM’s assisted search upon request by the Subscribers.

The ECM’s Lists of PEP contain records of those named subject persons largely conforming to common definition of PEP. For the purpose of CDD compliance, Subscribers are advised to require their clients to supply a list of the subject clients’ respective spouses, partners, children, parents and close associates for PEP checks.

Therefore, it is highly advisable for Subscribers to consult their own legal advisers whether such subject person is regarded as a PEP for the purpose of the Subscribers’ need in compliance with their respective legal and/or regulatory obligations.

Note: Pursuant to Hong Kong SFC’s Guideline on AML & CTF (2023-06 Edit), licensed institutes are required to perform CDD on both Hong Kong and non-Hong Kong PEP checks.

Subscribers are advised to conduct a identity verification of the Subject Person should there be any positive result from a PEP check due to possible common name of the concerned persons.
